About this document

A lease violation notice to tenant is a landlord's letter that names the lease term a tenant is not following and asks the tenant to correct the problem by a set date. The letter keeps a dated record while the tenancy continues.

Use a lease violation notice to tenant for problems a tenant can fix, such as parking, noise, trash or an unapproved pet. For routine entry, scheduled work or a rule reminder with no deadline, send a notice to tenant instead. A lease violation notice to tenant is not an eviction notice or a notice to quit. Many states set the cure period, wording and delivery method for a formal notice to cure, so check your state's rules before relying on this letter as one.

How to fill it in

  1. Quote the lease term. Find the signed lease and copy the exact clause the tenant is not following, with its section number and the lease date. A quoted clause is harder to dispute than a summary.
  2. List the facts and evidence. Write each incident with its date, what was seen or reported and by whom, and the photo, complaint or inspection note behind it. Leave out opinions and labels.
  3. Set a fair cure deadline. Name one specific action and a date and time to finish it. Give at least the time your lease and your state require, and list only next steps they allow.
  4. Check for accommodation or retaliation. If the issue involves an animal, a live-in aide or a possible disability, treat it as an accommodation request first. If the tenant recently complained about repairs, check your state's anti-retaliation rules.
  5. Deliver it and record delivery. Send it by a method your lease and state allow, record the delivery, and keep a copy. Have a lawyer licensed in your state review it before you rely on it as a statutory notice to cure.

[Rental property address and unit]

Dear [Tenant's name],

This notice is to let you know that you are not meeting a term of your lease dated [Lease date] for the property above. We want to resolve this and continue your tenancy. Please read this notice and take the steps below by the date given.

The lease term

Section [__] of your lease says:

"[Quote the lease clause exactly as written]"

What happened

[State the facts only: dates, times, what was seen or reported, and by whom. Leave out opinions and labels.]

  • [Date]: [What happened] ([Evidence, e.g. photo, written complaint, inspection note])

  • [Date]: [What happened] ([Evidence])

  • Earlier notices: [Dates of any earlier notices about the same issue, or "None"]

What you need to do

To correct this, please [Specific action, e.g. remove the second vehicle from the fire lane] no later than [Cure deadline: date and time].

[Give at least the time your lease and your state's law require. Some states set the cure period and the exact wording of a formal notice to cure. If you mean this letter to serve as that notice, use your state's required form and period instead.]

If the violation is not corrected

If the violation is not corrected by [Cure deadline], we may take further steps allowed by your lease and [State] law, which may include [e.g. the charge in Section __ of the lease, or a formal notice under the state statute that applies].

[List only steps your lease and state law allow.]

This notice does not end your tenancy and does not ask you to move out.

Questions, or if you disagree

If you believe this notice is wrong, or you need more time, please contact me by [Date] at [Phone or email]. If you need a change to a rule or policy because of a disability, you may ask for one, and I will consider it.

[If the issue involves an animal, a live-in aide or anything else that may relate to a disability, handle it as a possible accommodation request before treating it as a violation. If the tenant recently complained about repairs or contacted a housing agency, check your state's anti-retaliation rules before sending.]

Sincerely,
