About this document

A security deposit dispute response is a landlord's written reply to a tenant who objects to deductions from a security deposit. The reply checks each objection against the lease, the inspection reports, the photos and the invoices, and says whether each charge stands, is reduced or is withdrawn.

Use a security deposit dispute response after you have sent a security deposit itemization letter and the tenant has written back. A security deposit dispute response should answer each point rather than repeat the original statement. Where the evidence is thin, reducing the charge is often the fair answer, because several states let a tenant recover extra damages when a landlord keeps a deposit in bad faith. Check your state's deposit rules before you reply.

How to fill it in

  1. Gather the record. Collect the lease, your itemized statement, the move-in and move-out inspection reports, numbered photos and every invoice. Note the date the tenant's letter arrived.
  2. Fill in where things stand. Enter the deposit and any required interest held, your original deductions, the amount you withdraw or reduce, and the revised refund or balance. Check that the numbers add up.
  3. Answer each point. For every objection, summarize what the tenant said fairly, cite the evidence, and decide whether the charge stands, is reduced or is withdrawn. Withdraw charges for normal wear or with no move-in record.
  4. Send the refund and exhibits. Enclose any revised refund or give its payment date, attach the exhibits, and offer a call or mediation. If the tenant mentions small claims court, have a lawyer licensed in your state review the reply.
